According to USCIS data, 80% of I-829 petitions are taking roughly 41.5 months — almost three and a half years — to adjudicate. Two of our pre-RIA EB-5 investors recently received I-829 approvals in approximately four months, with no Requests for Evidence.

I-829 review centers on two questions: whether the investment has been fully deployed and has created at least 10 jobs, and whether the funds remained at risk and the investment was sustained throughout the conditional period.

The four-month outcome was not luck. It was a function of preparation that began at I-526. We had built a complete evidentiary record at the original filing — source-of-funds documentation, investment path, project structure — which then connected seamlessly to the I-829 stage. Pre-submission review eliminated logical gaps in job-creation and sustained-investment exhibits. Filings were timed to maximize adjudication efficiency.

Filed August 8 and October 28, 2025; approved December 10, 2025 and February 26, 2026.
