Source of funds is the central focus of EB-5 review, especially when funds involve cross-border corporate income, layered tax structures, or two petitions sharing a common funding source. We advised three petitioners from one family group whose petitions cleared in roughly six months.
The first petitioner's investment came from a loan against a family-controlled offshore enterprise with a long history in international trade. We documented the enterprise's continuous operating activity, modeled the loan's neutral effect on operations, and addressed cross-jurisdictional tax compliance.
The second and third petitioners — a parent and adult child filing in two batches because of age-out concerns — drew investment from the same overall family asset base. Here the central issue was demonstrating the independence of each petition's funds. We built two separate, fully traced funding structures with distinct allocation of investment amounts and supporting documentation.
